1. Introduction

By using Velvet, you agree to these Terms. If you do not agree, do not use the App.

2. Eligibility

• 13+ in US, 16+ in EU
• Legal capacity to enter a contract

3. Description of Service

Velvet is an AI fashion assistant providing:

• AI-based style recommendations
• Virtual try-ons using user avatars
• AI chat interactions

AI outputs are not professional advice.

4. User Accounts

• Create an account (email/password)
• Secure credentials
• Responsible for all activity under your account

5. User Content

• Upload selfies, photos, chat text
• Generated avatars and try-ons
• Users retain all rights
• Velvet may process content to provide services
• Content may be deleted upon account removal

6. Prohibited Conduct

No illegal content, no unauthorized access, no resale without permission, no interference with app operations.

7. AI-Generated Content Disclaimer

• AI outputs may be inaccurate or biased
• Virtual try-ons are approximate
• Velvet is not liable for styling or purchase decisions

8. Purchases

• Paid credits via third-party payment processors
• Purchases are non-refundable unless legally required

9. Intellectual Property

All app content is owned by Velvet or licensors. No copying, modification, or distribution without permission.

10. Third-Party Providers

Services rely on third-party providers for AI processing, storage, authentication, payments, and analytics. For AI image generation (avatar creation and virtual try-ons), we use Replicate (replicate.com). For AI-driven fashion search in chat, we use OpenAI (openai.com). Before any of your photos or personal data is sent to these AI providers, we obtain your explicit consent where required. Both providers are bound by data processing agreements that require equivalent data protection and limit use of your data solely to delivering the contracted service.

11. International Users

• EU/EEA users retain mandatory rights under law
• US law governs these Terms (Delaware)

12. Termination

Velvet may suspend or delete accounts for violation of Terms or fraudulent activity. Users may delete accounts anytime.

13. Limitation of Liability

• Velvet not liable for AI errors, lost data, or purchases
• Max liability: $50 or amount paid in last 12 months
• EU consumer rights are not waived

14. Binding Arbitration (US Users)

• Disputes resolved through binding arbitration in Delaware
• No class actions
• Exceptions: small claims court

15. Changes to Terms

• Updates will be communicated via in-app or email
• Continued use = acceptance
